Help! Thieving Employee Claims Disability Discrimination

Mark* is a clerk at 24-7 Stop & Go, a convenience store where he was hired two months ago. Carla, the general manager who also wears an HR hat, was counting his drawer after his shift and discovered the drawer was $80 short. How Do I Interview a Deaf Applicant?

I was reviewing applications for an open position and came across one that had marked “Yes” for the question regarding needing an accommodation in order to continue to participate in the recruitment process. This applicant is deaf and added a note to his application requesting an American Sign Language interpreter for the interview.

In the past when interviewing other deaf applicants, we always conducted the interviews in written format, allowing the applicant to write down their answers to the interview questions which we provided to them in writing.

Do I have to provide the applicant with a sign language interpreter? If yes, can I choose to use a virtual interpreter or does the interpreter have to be there in person?
